THE PRESIDENT OF RUSSIA SIGNED LAW DEVELOPED BY FAS RUSSIA AIMED AT SUPPORTING ENTREPRENEURS

The changes will optimize administrative procedures and support business in the current economic conditions

In particular, a moratorium has been established on the application of antimonopoly prohibitions in specific cases of procurement of goods, works, services for state and municipal needs from a single supplier. The moratorium will be in effect in 2022 in cases when the regional authorities decide on such a purchase in accordance with the legislation.*

It also provides for the right to choose a notification regime when making transactions of economic concentration when acquiring shares, interest, property and rights in respect of commercial organizations, the total value of assets of which ranges from 800 million rubles to 2 billion rubles. A similar right is provided for transactions with respect to financial organizations. In this case, FAS Russia must be notified no later than 30 days after the date of the transaction. At the same time, if transactions or other actions stipulated by law have led or may lead to restriction of competition, the antimonopoly authority has the right to issue remedies.

The changes also affected the improvement of the procedure for submitting an application for approval of preferences to FAS Russia. Now the authorities should not coordinate the granting of preferences to entrepreneurs in cases where they are provided for the purpose of social security of the population, support for small and medium-sized businesses, ensuring national defence and state security. They will only be required to notify FAS Russia about the granting of such preferences. At the same time, the antimonopoly authority will continue to closely monitor competition.

Besides, changes have been made to the legislation on advertising regarding the specifics of contracts for the installation and operation of advertising structures. This will allow funds to be directed to the primary needs of companies: salaries of employees and maintenance of the safety of the operation of advertising structures.
