CASSATION SUPPORTED FAS DECISION ON THE ROAD CARTEL IN LIPETSK REGION

The Arbitration Court of the Moscow District upheld the decision of FAS Russia regarding the Department of Roads and Transport of the Lipetsk Region, regional public institution Lipetsk Avtodor and TK Ruslan-1 LLC. It is worth noting that earlier the courts of two lower instances also supported the position of the agency.

It should be reminded that the authority, the state institution and the organization appealed the decision of the antimonopoly service to recognize them as violating the Law on Protection of Competition*. The companies entered into an anti-competitive agreement within the framework of an electronic auction for the repair of public roads in the Lipetsk region. The initial price of the contract was 305 million rubles.

Offenders will be brought to administrative responsibility in accordance with the Code of Administrative Offences of the Russian Federation.

*Article 16 of the Law on Protection of Competition prohibits agreements restricting competition between regional public authorities of subjects, other bodies and organizations performing their functions, as well as economic entities
