FAS IMPOSED A FINE OF 44.6 MILLION RUBLES ON THE PARTICIPANT OF THE COLLUSION

The company must transfer this sum to the federal budget for participating in an anti-competitive agreement in the road repair services market

It should be reminded that in October 2021, the Authority recognized the Department of Roads and Transport of the Lipetsk region, Regional State Institution "Lipetsk Avtodor" and TC Ruslan-1 LLC as violated the Law on Protection of Competition*. Earlier, the courts of three instances supported the position of the FAS Russia.

The companies concluded an anti-competitive agreement within the framework of an electronic auction for the repair of public roads in the Lipetsk region. During the auction, the commission of the customer, on the instructions of the organizer of the auction unlawfully rejected the applications of bona fide participants. As a result, TC Ruslan-1 LLC became the winner of the auction unreasonably. The initial (maximum) contract price was 305 million rubles.

For the conclusion and implementation of the anticompetitive agreement, the FAS Russia has imposed TC Ruslan-1 LLC a turnover fine in the amount of 44,620,657 rubles.

Currently, law enforcement agencies under these facts have initiated criminal cases against officials of the Department of Roads and Transport of the Lipetsk region and the Regional State Institution "Lipetsk Avtodor".
