CASSATION SUPPORTED THE FAS RUSSIA DECISION REGARDING THE RUSSIAN POST
The organization charged an additional allowance of 100% for parcels sent from/to hard-to-reach locations
The Arbitration Court of the Moscow District recognized the decision of the FAS Russia against AO Russian Post as legitimate.
Earlier, the Authority issued a warning to the company about the need to stop charging allowances in the amount of 100%. In connection with the failure to comply with the warning within the 10-day period established by law, the Authority initiated a case and recognized the organization as violating the Law on Protection of Competition*.
Even before the end of the case, the Russian Post refused to charge an allowance, as a result of which the Competition Authority decided not to issue a remedy to eliminate violations of antimonopoly legislation.
The withdrawal of the allowance allowed residents in hard-to-reach liaison offices to use postal services on equal terms with citizens of other regions.
It is worth noting that earlier the Arbitration Court of Moscow and the Ninth Arbitration Court of Appeal also supported the position of the FAS Russia. An administrative fine has been imposed on an organization for violating the antimonopoly legislation**.
