FAS RUSSIA ORGANIZES WORK ON UPDATING THE LAW ON ADVERTISING

FAS Russia, in cooperation with the industry, plans to make adjustments to certain provisions of the law

The work will be carried out on the base of the Expert Council on the Application of Legislation on Advertising and Protection against Unfair Competition at FAS Russia together with industry representatives and experts. It was stated by Ms. Karina Taukenova, Deputy Head of FAS Russia, at the Sixth National Advertising Forum.

The speaker noted that since the adoption of the Law on Advertising in 2006, there have been significant changes in the industry. Against the background of the development of technology, digitalization, the advent of online commerce, some provisions of the law are outdated or need clarification and additions, taking into account the new challenges and realities of the time.

Ms. Karina Taukenova also noted that FAS Russia receives various proposals from different groups of the advertising industry to adjust certain norms, which shows the existing request for the need to take joint measures.

In particular, the authority receives many appeals regarding advertising of financial services, advertising of promotional events, remote sale of goods, requirements for radio advertising. Ms. Karina Taukenova also said that FAS Russia, together with the regulatory guillotine working group, which includes representatives of the industry, discusses the need to clarify that the information on the company's website and in search results does not relate to advertising. In addition, push notifications are proposed to be recognized as advertising distributed over telecommunication networks.

The speaker also raised questions about the effectiveness of self-regulation of the advertising industry and provided statistics on violations of the Law on Advertising, which were detected by FAS Russia and the Regional offices of FAS Russia for the first half of the year.
