FAS INITIATED CASE AGAINST TNT TV CHANNEL FOR EXCEEDING THE PERMISSIBLE VOLUME OF ADVERTISING

The authority is working comprehensively to protect citizens from excessive sound effects of advertising

Every year, the antimonopoly service receives numerous appeals and complaints from citizens about advertising.

The Law on Advertising prohibits excessive exposure of sound advertising distributed in various ways. Thus, advertising is prohibited in TV and radio programs, the sound of which exceeds the average level of their volume. In addition, it is not allowed to distribute sound advertising using vehicles [1].

These restrictions have been valid since the adoption of the Law on Advertising in 2006 and protect citizens from the imposition of advertising, which customers cannot refuse when consuming services.

It should be noted that in 2021, the Law on Advertising also introduced a ban supported by FAS Russia on the distribution of advertising using sound equipment on buildings [2]. It will save citizens from excessive noise commercial activity in public spaces and forced listening to the same advertising information.

On the air of the TNT TV channel, the difference in the volume of advertisements, announcements and TV shows was higher than acceptable. As a result, the antimonopoly service initiated a case on the grounds of violation of advertising legislation.

If a violation is found, TNT-TELESET JSC faces liability in accordance with the Law on Advertising [3].
