TOMSK REGIONAL OFFICE OF FAS REVEALED ANTICOMPETITIVE AGREEMENT AND CARTEL AT AUCTION FOR MORE THAN 670 MILLION RUB

The materials of the antimonopoly case were transferred to law enforcement agencies to resolve the issue of initiating criminal cases

Tomsk Regional Office of FAS Russia has found the Tomsk Special Automobile Enterprise, MLT Transport LLC, MVM LLC and two companies ABF Logistics LLC, guilty of violating antimonopoly legislation*.

In 2020, the automobile company held three auctions to select a contractor for the transportation of solid utility exits of hazard classes 4 and 5.                                                 

The authority found that the customer created advantages for several participating companies. As a result, contracts were concluded at a cost significantly exceeding the cost of transported MSW set by the regional regulator. The sum of the initial (maximum) price of the three auctions was 675,676,814 rubles.

Besides, the authority found a cartel agreement between the two bidders**. Thus, ABF Logistics LLC and MVM LLC informed each other about the actions at the tenders. Organizations supported prices at two auctions with an initial (maximum) price of 438,514,253 rubles.

The evidence in the case was obtained, including through unscheduled on-site inspections conducted in 2021.

Organizations face turnover fines in accordance with the Code of Administrative Offences of the Russian Federation ***. The materials of the antimonopoly case were transferred to law enforcement agencies to resolve the issue of initiating a criminal case.
