FAS WILL TRANSFER AUCTION FOR THE LEASE OF STATE PROPERTY TO ELECTRONIC FORM

30-01-2023 | 13:57

FAS has developed a draft order which introduces appropriate changes to the Rules of auctions and tenders for the right to conclude contracts on the transfer of rights in respect of state or municipal property*

According to the current version of the Rules, bidding is possible only in a "paper" form. At the same time, the organizers of the auction from different regions of Russia appealed to FAS Russia with a proposal to consider the possibility of holding them in electronic form.

The developed document** will establish such a form of bidding, as well as a list of types of property in respect of which it will be possible to conclude a contract by holding a tender in electronic form.

The changes will provide for increasing the number of bidders and concluding contracts at the most favorable price by increasing the number of competing companies. It will increase revenues from leasing state and municipal property to the budgets of the Russian Federation.

In addition, the document will significantly simplify the bidding procedure, make participation in them more accessible and lead to an increase in the overall level of digitalization in the country.

* Rules for Holding Tenders or Auctions for the Right to Conclude Lease Agreements, Gratuitous Use Agreements, Trust Management Agreements, other Agreements Providing for the Transfer of Rights in Respect of State or Municipal Property, approved by Order of FAS Russia of February 10, 2010 No. 67

** Developed pursuant to Part 5 of Article 17.1 of Federal Law of July 26, 2006 No. 135-FZ "On Protection of Competition"
