FAS INITIATED CASE ON THE GROUNDS OF ANTICOMPETITIVE AGREEMENT IN THE TRANSPORTATION OF MSW
Regional operator and five MSW transporters created preferential conditions at the auction and limited the number of potential participants
FAS Russia has initiated a case* against a regional operator for the treatment of solid municipal waste (MSW) EcoStroyResurs LLC and transporters of such waste TransResurs LLC, Transeco LLC, Transcom LLC, Dakant LLC, Clean City JSC. The authority suspects the companies of concluding an anti-competitive agreement in order to limit the number of potential bidders and create preferential conditions for MSW transporters. Auctions for the provision of waste transportation services were held in the Samara region in 2019-2021.
Besides, the authority sees in the actions of MSW transporters signs of a cartel ** in order to maintain prices at auction.
The companies' actions led to the conclusion of most contracts with minimal price reduction. The total amount of initial (maximum) contract prices was 31,277,955,460 rubles.
In case of fault, companies face turnover fines from the amount of revenue on the market in accordance with the Code of Administrative Offences of the Russian Federation ***.
