FAS ISSUED WARNING TO ORSK NON-METALLIC COMPANY FOR UNJUSTIFIED REFUSAL TO SUPPLY RAW MATERIALS
The largest clay producer justified it by initiating an antimonopoly case
Earlier, FAS Russia initiated a case against the organization on violation of antimonopoly legislation. According to the authority, in 2022 Orsk Non-Metallic Company JSC increased the price of clay by 4 times. At the same time, the analysis of the company's economic activity indicators showed that the price set by it exceeds the amount of necessary expenses and profits for production and sale.
Referring to the initiation of the antimonopoly case by FAS Russia, Orsk Non-Metallic Company announced to individual counterparties that the shipment of raw materials would be suspended until the end of proceedings and decision of FAS Russia. However, the fact that an antimonopoly case has been initiated does not affect the normal business activities of the organization. Therefore, such actions can be considered as economically or technologically unjustified refusal or evasion from concluding a contract with individual buyers*.
The company was issued a warning about the need to resume the supply of raw materials within 10 days from the date of its receipt, after which the company should inform the antimonopoly service within 3 days.
