COURT SUPPORTED IRKUTSK OFAS ON UNJUSTIFIED ENLARGEMENT OF THE LOT FOR PLACEMENT OF ADVERTISING STRUCTURES

The violation was revealed during an electronic bid for the right to conclude contracts for the installation of advertising structures on municipal buildings and land plots

According to the applicant, the organizer of the bid, the Committee for Economic and Strategic Planning of the Irkutsk City Administration, unreasonably enlarged the lot by including 88 places for advertising structures in the form of LED screens. At the same time, in the framework of other bids in 2023, most of the lots included only one place for advertising structure. This approach to the formation of the lot led to an unreasonable rise in cost and contributed to the restriction of competition, thereby violating the rights of bidders.

The Commission of the Irkutsk Regional office of FAS Russia recognized the complaint as justified. The authority concluded that such lot formation limits the ability of local entrepreneurs to participate in advertising. According to the Irkutsk Regional office, it should be divided into several smaller lots, which will expand the number of bidders and provide access to the installation of advertising structures for more household facilities. The bid organizer has been issued an order to eliminate the violations committed.

The Arbitration Court of the Irkutsk region supported the ruling and the remedies of the regional office of the authority.
