SUPREME COURT CONFIRMED LEGALITY OF FAS 906 MILLION RUB FINE AGAINST APPLE

The court refused to transfer the company's complaint about the penalty

Recall that in 2020, FAS Russia recognized Apple as violating antimonopoly legislation. The case was initiated on the application of Kaspersky Lab.

It was found that Apple abused its dominant position in the market for the distribution of mobile applications on the iOS operating system by performing a series of sequential actions that led to the provision of competitive advantages to its own products and at the same time worsening the conditions for the distribution of competitors' products – parental control applications.

The company appealed the decision and the order of the authority, as well as the decision to impose a fine of 906 299 392 rubles in court. However, in 2022 and 2023, the courts of three instances supported the position of FAS Russia, after which the company complied with the order and paid the fine.

Apple tried to appeal the decision of the Moscow Arbitration Court, as well as the decisions of the appellate and cassation instances, but the Supreme Court of the Russian Federation refused to transfer the company's complaint about the legality of the fine of the antimonopoly service.
