FAS: ANTIMONOPOLY AUTHORITIES PLAY IMPORTANT ROLE IN PROTECTING INTELLECTUAL PROPERTY RIGHTS
It was noted by Yana Sklyarova, Deputy Head of the Department for Control of Advertising and Unfair Competition of FAS Russia, at the regional seminar "Intellectual Property is a key factor of integration in the Eurasian space" in the Republic of Belarus
The main topic of the seminar was the problematic issues of intellectual property rights protection, including the opportunities and advantages of market players applying to various administrative or judicial procedures, as well as improving the regulatory environment in cross-border markets.
Antimonopoly authorities have unique powers – they have the right to stop such dangerous practices as parasitic competition or abuse of rights holders in relation to independent importers and manufacturers of consumables.
However, according to FAS Russia, in the modern world it is necessary to look for new legal solutions to curb abuses in the digital environment. To this end, the authority is working to improve legislation, including identifying owners of digital platforms as special market participants.
Besides, jointly with other regulators, the authority pays special attention to the problem of the legality of the turnover of the results of intellectual activity in Internet sales. The development of good practices to combat counterfeiting is conducted in a dialogue with public organizations and business associations.
Moreover, FAS Russia is actively working to curb unfair competition. In particular, unfair attempts to use databases or the use of various forms of consumer fraud in the design of websites and in Internet marketing have been repeatedly suppressed.
Consistency of approach of the law "On Protection of Competition" and the legislation of the Republic of Belarus, as well as the EAEU as a whole, creates favorable conditions for the mutual use of established practices in the application of antimonopoly legislation to protect and promote the fair use of intellectual property.
