COURT UPHELD EXCLUSION OF 110.83 MILLION RUB OF UNJUSTIFIED FUNDS FROM ELECTRICITY TARIFFS IN ARKHANGELSK REGION

This will eliminate the unreasonable tariff burden on consumers
In 2021, the authority conducted an inspection of the Agency for Tariffs and Prices of the Arkhangelsk Region regarding the economic feasibility of tariffs for the branch of PJSC Rosseti North-West - Arkhenergo.
Based on its results, FAS Russia ordered the regulator to exclude from the company's expenses the illegally recorded amount of income tax in the amount of 110.83 million rubles and conduct an additional analysis of expenses for other cost items.
The company did not agree with the remedies of the authority and applied to the Arbitration Court of Moscow with a statement to invalidate it in terms of exclusion from the taxable income of expenses under the item "Income Tax" for 2019-2021.
Arkhenergo challenged the remedies, but the courts of first and cassation instances supported the position of FAS Russia.
The execution of the remedies remains under the control of the authority.
