FAS IMPOSED FINE ON EVALAR CJSC FOR VIOLATION OF ADVERTISING LEGISLATION

The advertiser guaranteed consumers a positive result from the use of the medicine "Sabelnik tincture"

As it was found by FAS Russia, the advertiser reported on the positive effect of the medicine and effective relief from pain in the treatment of joints. The advertisement also claimed that the medicine is harmless to the stomach and effective due to its natural composition.

In accordance with the legislation, advertising of medicines should not guarantee their positive effect, safety, effectiveness and absence of side effects. In addition, the law prohibits the assertion in advertising that the safety and effectiveness of the advertised object are guaranteed by its natural origin*.

The authority recognized the advertisement as improper and imposed a fine on Evalar CJSC for violating advertising legislation. Due to the fact that in 2023 the company was already brought to administrative responsibility for a similar violation, the amount of the fine was increased to 350 thousand rubles.
