FAS PROTECTED RIGHTS OF PERSONS WITH DISABILITIES IN GRANTING TWO PREFERENCES

According to the ruling of the authority, such citizens will have to make up at least 50 % of the total number of employees of organizations receiving preferences

As part of the notification procedure* for preferences, the Property Relations Committee of St. Petersburg and the Administration of the Volzhsky City District of the Volgograd Region leased non-residential real estate objects to the Creative Studio Russian Birch Bark and Roden LLC, respectively, for the purpose of social security of the population.

The authority found that the organizations are engaged in the provision of social services and assist in the employment of persons with disabilities. In addition, the companies meet the requirements for social enterprises, and their activities meet the stated purpose of preferences.

The authority has established a requirement that persons with disabilities must make up at least 50 % of the total number of employees of organizations. A requirement has also been introduced for the necessary shares of the labor costs of such persons, which will exclude their discrimination in establishing and changing the terms of payment.

FAS Russia will monitor compliance with the requirements of antimonopoly legislation when using preferences. If violations are detected, the authority issues an order to take appropriate measures**.

* According to Article 15.2 of Federal Law No. 46-FZ of 08.03.2022, the notification procedure for granting preferences is applied when they are issued for the purposes of social security of the population, support for small and medium-sized businesses, ensuring the country's defense capability and state security.
