IN ORDER TO INCREASE TRANSPARENCY OF PROCUREMENT AND PROMOTE COMPETITION, FAS CONSIDERS IT INAPPROPRIATE TO EXTEND PROVISIONS OF LAW NO. 46-FZ

The regions are running a chance of facing negative consequences for the economy in the long term due to a decrease in business activity and a reduction in the number of procurement participants

Maxim Shaskolsky, Head of FAS Russia, told about it during the VII St. Petersburg International Forum of Contract Relations. He draw attention that the authority notes the positive dynamics and the restoration of the activity of procurement participants. In this regard, FAS Russia believes it possible to complete the practice of individual regions to conclude contracts with a single supplier.

In order to analyze the competitive environment of procurement, the authority monitors contracts concluded with a single supplier on the basis of the Federal Law No. 46-FZ. Thus, according to the Unified Information System in the Field of Procurement, over the period of its operation, more than 37 thousand contracts were concluded with a single supplier for an amount exceeding 1.6 trillion rubles. In particular, in 2022, the cost of contracts concluded in accordance with the Federal Law No. 46-FZ amounted to 13 % of the cost of competitive procurement. At the same time, the number of such contracts was 1 %. As a result, the amount of budget funds contracted on the basis of the Federal Law No. 46-FZ is distributed among a smaller number of suppliers than according to the results of competitive procedures.

Besides, FAS Russia faces individual cases of irrational application of the proposed mechanism.

Maxim Shaskolsky also reported on the results of the control activity of the Authority in the field of procurement. Thus, in the first half of 2023, the number of complaints received (28,138) increased by 27.7 % compared to the same period in 2022 (22,030). According to the agency, in particular the reason is an increase in the number of posted notices.

FAS Russia continues to work to restrict the activities of professional complainants. Therefore, in order to avoid possible manipulations related to the withdrawal of the complaint, the authority instructed all its regional bodies about the need to respond to the withdrawn complaints. Regardless of the reason for the recall, the Commission of FAS Russia will conduct an unscheduled inspection of the purchase based on the received complaint of a possible violation.
