COURT SUPPORTED FAS IN CASES OF AGREEMENTS AT AUCTIONS FOR THE TRANSPORTATION OF MSW

The violating companies were fined for concluding anticompetitive agreements for 325 million rubles

It should be reminded that in September 2022, FAS Russia recognized Clean City LLC and Ecosystem Company LLC as violating antimonopoly legislation. The companies concluded a cartel agreement, which resulted in the restriction of competition when bidding for the provision of services for the transportation of MSW in the Kurgan region in 2019. The total value of the concluded contracts is 750,664,867 rubles.

Besides, FAS Russia recognized regional MSW transporters as having violated the antimonopoly legislation: Ecosystem LLC, Transservice LLC, Turaservice-N LLC, Ecotrans LLC, PTK LLC. The organizations concluded an agreement to maintain prices at auctions for the right to provide services for the transportation of MSW in the Sverdlovsk, Kurgan, Tyumen, Murmansk regions and Khanty-Mansi Autonomous Area – Yugra in 2019-2021. The total value of the concluded contracts amounted to 6,993,825,203 rubles.

Fines totaling 325,409,640 rubles were imposed on companies for the conclusion and implementation of agreements restricting competition.

The violators tried to challenge the ruling of FAS Russia and the decision to impose fines, but the Arbitration Court of the Moscow city supported position of the authority.
