FAS: POSSIBILITY OF CONCLUDING AGREEMENTS ON PRICE STABILIZATION IN 4 REGIONS WILL COVER ALL GOODS

At the same time, the regions will continue to independently determine the need for such agreements and products for which they will be concluded

Relevant amendments have been made to Government Resolution No. 662*. Now the document provides the regional state authorities of the DPR, LPR, Kherson and Zaporozhye regions with temporary powers to conclude agreements with retail chains on price stabilization not only for socially important food products**, but for all food and non-food items.

Such proposals were previously received by the Service from the authorities of these regions. They requested to expand the list of products for which agreements could be concluded.

Other regions will still be able to conclude agreements on price stabilization for socially important food products.

Bearing in mind the voluntary nature of the signing of agreements, according to the Authority, the implementation of Government Resolution No. 662, taking into account the changes made, will help to stabilize prices for goods and increase their accessibility for citizens.

FAS Russia reminds that regional authorities must notify the antimonopoly agency of the signing of the agreement within 5 working days. The authority closely monitors the compliance of these documents with all the requirements established by the resolution, including the condition on the voluntary nature of these agreements.

 

* Resolution of the Government of the Russian Federation No. 662 of 26.04.2023 "On Cases of Permissibility of Agreements Concluded by State Authorities of the Subjects of the Russian Federation with Economic Entities in order to Stabilize Prices for Goods Included in the List of Certain Types of Socially Important Food Necessities for which Maximum Permissible Retail Prices Can Be Established" was adopted in accordance with part 2 of Article 13 of Federal Law No. 135-FZ of 26.07.2006 "On Protection of Competition", according to which the Government of the Russian Federation has the right to determine the cases of the permissibility of concluding agreements on the proposal of the federal antimonopoly authority.

** The list includes 24 items of food products. It is provided for in Article 8 of the Federal Law of December 28, 2009 No. 381-FZ "On the Basics of State Regulation of Trading Activities in the Russian Federation" and approved by the Resolution of the Government of the Russian Federation No. 530 of July 15, 2010.
