FROM MARCH 1, 2024 AUTHORITIES WILL BE ABLE TO HOLD CONCESSION TENDERS IN ELECTRONIC FORMAT

It was stated by Oleg Korneev, Head of the Department for Control of Construction and Natural Resources of FAS Russia, at a session within the framework of the RBC conference "Public Private Partnership in Russia: Synergy of Business and the State"

A number of changes have been made to the legislation on concessions. Thus, the order of competitive procedures for the right to conclude concession agreements has been changed. Starting from March 1, 2024, the concedents will have the opportunity to hold a competition on electronic platforms operating within the framework of the legislation on the contract system. From January 1, 2026 the procedure will be carried out only in electronic form.

Besides, when placing a private concession initiative, persons applying to participate in the competition must provide a package of supporting documents identical to the package of the initiator.

Oleg Korneev noted that the procedure for agreeing on the essential terms of concession agreements had been clarified. In particular, now the concession agreement does not require the approval of the antimonopoly authority, if the concessionaire selected without competition is determined by a decision of the Government of the Russian Federation.

The speaker also recalled the moratorium on approving changes to the terms of concession agreements, which is valid until January 1, 2024. The exceptions are housing and communal services, electric power, gas supply and MSW facilities.
