FAS ISSUED A WARNING TO NOVOSIBIRSK HEATING GRID COMPANY

The signs of violation of antimonopoly legislation were revealed in the actions of the organization

FAS Russia received a complaint from the management company UKEZH Siberian Initiative LLC.

As a result of reviewing the appeal, the Authority revealed in the resource supply contracts of Novosibirsk Heating Grid Company LLC (NTSK LLC) the imposition of conditions on charging for the loss of thermal energy on the pipeline section from the wall of the house to the installation site of a general household metering device.

In addition, according to the analysis, NTSK LLC posted on its website a standard form of a resource supply agreement, which contains similar conditions for all housing organizations.

The legislation of the Russian Federation provides for a closed list of ways to measure the volume of a resource that is supplied to a house: according to the indication of a metering device or according to a standard established by the region.

Housing Code of the Russian Federation provides that the payment of the management company to the resource supply organization cannot be more than the amount of the utility fee, which is transferred by citizens to the management company.

FAS Russia concluded that imposing additional financial obligations on the managing organization may entail their transfer to citizens.

In this regard, the authority issued a warning to NTSK LLC with the requirement to exclude from the standard form on the company's website and from all contracts already concluded the terms that infringe the rights of entrepreneurs and consumers.
