FAS REVIELED ILLEGAL COORDINATION OF ECONOMIC ACTIVITIES DURING BANKRUPTCY PROCEEDINGS
The Authority recognized the Association "National Organization of Arbitration Managers" as violating antimonopoly legislation
FAS Russia found that local regulations of a self-regulatory organization (SRO) contain requirements that are not provided for by law. The existence of such requirements, as well as sanctions for non-compliance with them, led to the refusal of SRO members to conclude service contracts with persons not accredited by the Association*.
Based on the results of the case review, the Authority issued a remedy to the SRO to stop the illegal coordination of economic activities. The Association should exclude from its local regulations requirements that are not provided for by the legislation.
The Association also faces an administrative fine in accordance with the Administrative Code of the Russian Federation**.
