THE CASSATION CONFIRMED THE LEGALITY OF THE FAS FINES IN THE AMOUNT OF 484.3 MILLION RUBLES AGAINST YUZHURALMOST

The company must pay the fine to the federal budget for concluding two anti-competitive agreements

The Moscow Arbitration Court recognized the legality of the FAS Russia decisions in relation to AO Yuzhuralmost.

In March 2019, the Authority recognized the organization as violating the Law on Protection of Competition*. The result of such actions of the company was the restriction of competition in the market of construction, reconstruction and repair of highways in the Chelyabinsk region.

Anticompetitive agreements have been implemented during 10 auctions totaling almost 2.4 billion rubles. At the same time, the reduction in the price of contracts did not exceed 1.5%.

FAS Russia imposed two fines on the organization totaling 484,328,323 rubles.

It should be noted that earlier the Moscow Arbitration Court and the Ninth Arbitration Court of Appeal also upheld the decisions of the Authority.
