APPEAL UPHELD LEGALITY OF 484.3 MILLION RUB FINES IMPOSED BY FAS AGAINST YUZHURALMOST JSC
The company will pay it to the federal budget for the conclusion of two anticompetitive agreements during construction procurement
In March 2019, FAS Russia recognized Yuzhuralmost JSC as violating antimonopoly legislation. As a result of anticompetitive agreements, the company became the winner of 10 auctions totaling almost 2.4 billion rubles. At the same time, the reduction in the price of contracts did not exceed 1.5%.
FAS Russia imposed two fines on the organization for violations of the Law on Protection of Competition* totaling 484,328,323 rubles.
The company filed a lawsuit to appeal the fines, but the Ninth Arbitration Court of Appeal confirmed the legality of the fines. Earlier, the position of FAS Russia was supported by the court of first instance.
It should be noted that the court of cassation also confirmed the legality of the decision of FAS Russia in the case of violation of the antimonopoly legislation by Yuzhuralmost.
