Created in May 2016 in accordance with the Memorandum of Understanding on cooperation in the field of competition law and policy of the BRICS countries.
Main objectives:
- elaboration of specific proposals for the formation of a competition environment in the automobile markets;
- exchange of experience and approaches to the application of antimonopoly laws in the automobile markets;
- preventing unscrupulous practices of the largest automobile companies, creating fair conditions for all market participants;
- development of new mechanisms to combat cartels and other anticompetitive agreements between headquarters and original equipment manufacturers, as well as authorized and unauthorized dealer companies;
- combating violations of antimonopoly legislation in the automobile markets related to after-sales service: insurance, repair;
- developing a coherent approach to the consideration of global transactions of economic concentration in the automobile markets.
Priority issues for study:
- questions of the methodology for determining the automobile market / market analysis;
- issues related to the detection and suppression of violations of antimonopoly laws in the automobile markets;
- issues of application of "soft law" in the automobile markets in the territory of the BRICS countries, for example, through the introduction of the Code of Conduct for automakers;
- issues related to anticompetitive agreements concluded between headquarters and original equipment manufacturers, as well as authorized and unauthorized dealer companies;
- issues related to the consideration of transactions of economic concentration in the automobile markets;
- issues of observance of intellectual property rights of manufacturers of original auto parts.
Action Plan:
The meetings of the Working Group are held regularly once or twice a year. Regular contacts are also held in the format of calls, videoconferences, webinars, consultations, meetings.
