COURT CONFIRMED CARTEL AT 331 PHARMACEUTICAL AUCTIONS

Appeal Court supported FAS decision regarding a cartel of “Euroservice Firm” CJSC and “Mega Pharma” Ltd.

The companies are found guilty of maintaining prices in the course of auctions for supplying medicine, medical materials, tools and equipment. The overall income gained as a result of participating in the cartel exceeded 800 million RUB.

The 9th Arbitration Appeal Court in Moscow confirmed legitimacy and reasonableness of the decision of the antimonopoly authority and reversed the ruling of the Court of First Instance, according to which concluding a trust agreement, “Euroservice Firm” CJSC and “Mega Pharma” Ltd. formed a subordinate group of persons within the meaning of the Federal Law “On Protection of Competition” and do not fall under the ban of cartels.

Head of FAS Anti-Cartel Department, Andrey Tenishev commented: “The ruling of the Appeal Court clearly demonstrated uniform interpretation of the law and the common goal to counter cartels, especially on the socially important markets”.
