MOSCOW

 

1. To approve the attached National Plan ("roadmap") for the Development of Competition in the Russian Federation for 2021-2025 (hereinafter – "National Plan")

2. The implementation of the National Plan is carried out by the relevant federal executive bodies within the established number of employees of their central and regional offices and the budgetary allocations provided in the federal budget for the performance of their functions in the established field.

3. Heads of federal executive bodies responsible for the implementation of the National Plan shall:

  • ensure the implementation of the National Plan;
  • send information on the implementation of the National Plan to the FAS Russia on a quarterly basis, not later than the 5th day of the month following the reporting quarter.

4.The FAS Russia shall:

  • ensure monitoring and control of the implementation of the National Plan;
  • submit information on the implementation of the National Plan to the Government of the Russian Federation on a quarterly basis, not later than the 25th day of the month following the reporting quarter.

5. To recommend to the state authorities of the constituent entities of the Russian Federation:

  • to ensure annual publication of information on the results of the implementation of the state policy on the development of competition, including the provisions of the National Plan on the official websites of the executive authorities responsible for the implementation of the state policy on the development of competition in the constituent entities of the Russian Federation;
  • to approve roadmaps for the promotion of the development of competition in the constituent entities of the Russian Federation for 2022-2025 before January 1, 2022;
  • to ensure equal access of educational organizations of all forms of ownership and individual entrepreneurs to participation in the system of personalized financing of additional education for children (with the exception of financing additional education in children's art schools) before December 31, 2023;
  • to ensure the implementation of measures aimed at increasing the number of non-stationary and mobile retail facilities, as well as their retail spaces by December 31, 2024;
  • to determine the composition of the property owned by the constituent entities of the Russian Federation that is not used to implement the functions and powers of state authorities of the constituent entities of the Russian Federation before January 1, 2024;

by December 31, 2025:

  • to ensure the privatization of property owned by the constituent entities of the Russian Federation that is not used to implement the functions and powers of state authorities of the constituent entities of the Russian Federation;
  • with the participation of local government authorities, to ensure the organization of an inventory of cemeteries and burial places, based on the results of such an inventory, to create and maintain in the constituent entities of the Russian Federation the registers of cemeteries and burial places and publish them on regional portals of state and municipal services.

6. To recommend to local government authorities:

  • to ensure the implementation of measures aimed at increasing the number of non-stationary and mobile retail facilities and retail spaces for them by December 31, 2024;
  • to determine municipal property that does not meet the requirements for categorization of property intended for the implementation of the functions and powers of local government authorities before January 1, 2024;
  • to ensure the privatization or reprofiling (change of purpose of property) of municipal property that does not meet the requirements for categorization of property intended for the implementation of the functions and powers of local government authorities before December 31, 2025.

NATIONAL PLAN ("ROADMAP") for the development of competition in the Russian Federation for 2021-2025

 

I.             Evaluation of the implementation of the state policy on the development of competition

 

Decree of the President of the Russian Federation No. 474 of July 21, 2020 "On the National Development Goals of the Russian Federation unitl 2030" defines five national development goals of the Russian Federation:

  • preservation of the population, health and well-being of people;
  • opportunities for self-realization and talent development;
  • comfortable and safe living environment;
  • decent, efficient labor and successful entrepreneurship;
  • digital transformation.

Achieving these national goals is a multifaceted task, the solution to which largely depends on the effectiveness of the state policy in a wide range of areas – from macroeconomic policy, creating a favorable investment climate, including the development of the financial and tax system, reducing administrative and infrastructural barriers to protecting the rights of citizens and regional policy.

Competition policy is a set of consistent measures taken by the state in order to provide conditions for competition between economic entities, increase the efficiency and competitiveness of the Russian economy, modernize enterprises and create conditions for providing citizens with goods and services in a cost-effective way.

On December 21, 2017 the Executive Order of the President of the Russian Federation No. 618 "On State Competition Policy Guidelines" was adopted (hereinafter – the Executive Order No. 618). The key goal of the Executive Order No. 618 is enhancing national economy, increasing customer satisfaction by expanding the range of goods, works, services, improving their quality and reducing prices.

Therefore, meeting competition development objectives is one of the key elements for ensuring achievement of national goals.

The National Plan for the Development of Competition in the Russian Federation for 2018-2020, approved by the Executive Order No. 618, is focused on achieving the competition development objectives and goals in the key sectors of economy.

On April 5, 2018 the meeting of the State Council of the Russian Federation was held in order to discuss priority areas of activities in the constituent entities of the Russian Federation for competition development.

Main approaches to implementation of the pro-competitive policy in the regions of the Russian Federation are embodied in the standard of the competition development in the constituent entities of the Russian Federation, approved by the Decree of the Government of the Russian Federation No. 768-р of April 17, 2019.

Competition development issues have become an integral part of the regional economic policy, and "roadmaps" for competition development in commodity markets, aimed at achieving key indicators established at regional level, have been developed and are being implemented in all constituent entities of the Russian Federation.

Today the implementation of existing strategic documents and orders has led to the creation of legal and organizational framework of competition development in the Russian Federation.

Positive role in the development of competition belongs to state programs and competition development plans implemented before 2018, including:

State Program for Demonopolization of Economy and Development of Competition in the Markets of the Russian Federation (Fundamental Directions and Priority Measures), approved by the Decree of the Government of the Russian Federation No. 191 of March 9, 1994 "On the State Program for Demonopolization of Economy and Development of Competition in the Markets of the Russian Federation (Fundamental Directions and Priority Measures)";

Program on Competition Development in the Russian Federation, approved by the Decree of the Government of the Russian Federation No. 691-р of May 19, 2009;

Action plan ("roadmap") "Development of Competition and Improvement of Antimonopoly Policy", approved by the Decree of the Government of the Russian Federation No. 2579-р of December 28, 2012.

Certain results have been achieved following the implementation of the National Plan for the Development of Competition in the Russian Federation for 2018-2020, approved by the Executive Order No. 618, action plan ("roadmap") for development of competition in economic sectors of the Russian Federation and transition of selected natural monopolies from the state of natural monopoly to a competitive market for 2018-2020, approved by the Decree of the Government of the Russian Federation No. 1697-р of August 16, 2018.

Thus, it has been possible to ensure a minimum of three economic entities with at least one of them from private sector in each economic sector of the Russian Federation apart from natural monopolies and defense-industrial sector.

This key indicator reflects quantitative change of the state of competition in commodity markets while laying the foundation for meeting objectives relating to qualitative changes.

The number of cases concerning violations of antimonopoly legislation by public and self-governing authorities reduced in half in 2020 comparing to 2017.  

Among activities implemented under the National Plan on the Development of Competition in the Russian Federation for 2018-2020, the most significant ones in terms of the economic effect and positive impact on the economy of the Russian Federation are the following:

  • introduction of the Federal Law "On Amendments to the Federal Law "On State and Municipal Unitary Enterprises" and the Federal Law "On Protection of Competition", aimed at prohibiting unitary enterprises in the competitive markets and reducing the state sector’s share in the economy;
  • abolition of national and intra-network roaming on the territory of the Russian Federation;
  • implementation of regulations on non-discriminatory access to public postal service and heat supply markets;
  • extension of the scope of exchange trade of spot goods (oil, petroleum products, natural gas, wood, sugar, grain etc.) and derivative financial instruments, improvement in marketability of the main types of agriculture products in agroindustrial complex, expansion of sales geography of goods, sold on exchange;
  • holding, in the context of enhanced fight against cartels and other anticompetitive agreements, of the 18 session of the UNCTAD Intergovernmental Group of Experts on Competition Law and Policy, which resulted in the approval of the Guiding Policies and Procedures under Section F of the UN Set on Competition;
  • limitation of possibility for regional executive authorities to take decisions on establishing indices for utility charges higher than limit levels;
  • integration of the principle of price (tariffs) regulation, stimulating organizations to reduce costs;
  • integration of the method of marginal pricing for public telecommunication and postal services;
  • transition to market pricing through the formation of exchange-traded and over-the-counter price indicators for natural gas in the field of gas supply.

Implementation of the abovementioned activities contributed to the achievement of objectives and goals, defined by the Executive Order No. 618, including:

  • development of competition in the areas of economic activity of state enterprises with state participation (in particular, the number of unitary enterprises decreased by 31.8% in 2018-2020);
  • increased customer satisfaction, including by lowering prices (as a result of the abolition of intra-network roaming, savings for consumers amounted to about 6 billion rubles and volume of these communication services increased);
  • equal access to goods and services of subjects of natural monopolies (in particular, as a result of the implementation of regulations on non-discriminatory access to heat supply market, conditions have been created to overcome barriers, such as excessive documentary requirements, unreasonable refusal to provide services, long wait, and no guarantee of results in the process of consumers accessing services).

However, not all measures provided for by the programs turned out to be sufficient for the effective competition development.

At the beginning of the current decade, the Russian economy faced long-term systemic challenges, reflecting both global trends and internal development barriers.

Analysis of global economic processes allows us to draw conclusions about a significant change in traditional approaches and the system of economic relations. Digital transformation has become one of the main factors of global economic growth at the present stage.

Structural shifts in the economy are happening more and more rapidly. The changes taking place are so significant that they can be characterized as the largest technological transition in history, when the abundance of natural resources and the inexpensiveness of labor are no longer the main factors of economic growth.

Another challenge for the Russian economy and the global economy as a whole was the spread of the new coronavirus infection (COVID-19). Many countries around the world have taken preventive measures: closed borders, stopped air traffic, introduced self-isolation and quarantine regimes.

The following factors continue to restrain the development of competition:

  • high share of public sector in the economy;
  • monopolization of markets and their oligopoly nature;
  • insufficient share of amsll and medium-sized business in the structure of the Russian economy;
  • continued barriers to access infrastructure.

Each of the above factors directly affect the stability of the economic "immunity" of the Russian Federation to the current situation and developing global economic crisis.

Addressing issues of improving legal and organizational measures to ensure, protect and develop competition, which make it possible to withstand global economic challenges, is possible only if internal restrictions that hinder economic growth are overcome.

At the next stage of the implementation of the state policy on the development of competition, qualitative systemic, institutional and organizational changes are needed, as well as further steps to develop competition in the sectors of the national economy.

 

II.             Evaluation of the implementation of the state policy on the development of competition

 

1. The objectives of the National Plan ("roadmap") for the Development of Competition in the Russian Federation for 2021-2025 (hereinafter – "National Plan") are determined by the goals of ensuring economic growth and the need to overcome barriers restraining the development of the Russian economy, and include:

  • development of fair competition in commodity markets;
  • reduction of barriers for suppliers and consumers of goods, works and services;
  • deregulation of the spheres of natural monopolies and certain regulated areas of activity in which conditions for the development of competition have been created, based on analysis of the state of competition;
  • ensuring effective and transparent management of state and municipal property, including drawing into economic circulation of unused and non-core state and municipal property (including in the social sphere), unification of procedures for disposing state and municipal property on the basis of online auctions;
  • ensuring equal operational environment in competitive markets for state-owned companies and privately owned companies;
  • development of small and medium-sized businesses;
  • unification and systematization of state and municipal preferences to economic entities;
  • replacement of measures of state regulation of economic relations with measures of economic stimulation;
  • ensuring non-discriminatory access to natural resources;
  • development of organized (on-exchange) trade of goods, derivative financial instruments, underlying asset of which is a commodity, including creation in the Russian Federation of on-exchange commodity market of futures contracts and other commodity derivatives meeting international standards, creation of conditions for export sales of on-exchange goods on Russian exchanges for rubles;
  • digitalization of antimonopoly and tariff regulation;
  • expanding and improving the efficiency of international cooperation aimed at ensuring protection and development of competition, as well as restoring conditions for competition in the Russian Federation in case of violation of antimonopoly legislation;
  • creating conditions for the development of competition in the field of state defence order, stimulating increase in the share of government contracts concluded through competitive procedures, and increasing efficiency of the pricing mechanism in the field of state defence order;
  • development of interspecific competition and competition between companies in the field of transport, taking into account the need to ensure the safety and financial stability of carriers.

2. In order to control the fulfillment of the tasks set and achieve the goals of improving the state policy on the development of competition, the following key indicators of the development of competition are established:
