FAS opened a case against “MegaFon”, “MTS” and “VympelCom”
The Federal Antimonopoly Service (FAS Russia) opened a case against “MegaFon” OJSC, “MTS” OJSC and “VympelCom”OJSC due to introduction of customer accounting of SMS-traffic for SMS-aggregators, which increased the tariffs for the end-customers of bulk SMS (elements of violating Part 1 Article 10 of the Federal Law “On Protection of Competition”).
When SMS-traffic became more expensive, FAS received claims from end-customers of bulk SMS – “National Processing Centre” Ltd. and “SOGAZ-MED” Insurance Company” OJSC that order the services of SMS-aggregators for bulk SMS to the networks of providers.
Earlier the settlement system between an SMS-aggregator and a provider for the rendered services was based on the overall volume of SMS-traffic from all end-customer of bulk SMS to the subscribers of the provider sent via the equipment of the SMS-aggregator. FAS established that after introducing the customer accounting system an SMS-aggregator pays to a provider on a monthly basis for the volume of SMS-traffic from every end-customer of bulk SMS.
The changes in the settlement procedure resulted in increased tariffs for the end-customers of bulk SMS.
The case hearing is scheduled on 25 February 2016.
