The Federal Antimonopoly Service (FAS Russia) sent a warning to the General Director of the "Federal Freight Company" OJSC ("FGK") Alexei Taicher that exercising actions, which can lead to violating the antimonopoly law, is unacceptable.

The warning was issued upon a public statement that in 2016 "FGK" plans to increase the rates for open cars to 900 RUB /per day/ per car. The announcement was made on 3 March 2016 at the Consumer Council on the work of "Russian Railways" OJSC.

Guided by Article 25.7 of the Federal Law "On Protection of Competition", FAS warns  the "Federal Freight Company" OJSC not to exercise the planned actions since such a conduct can lead to violating the antimonopoly law.

Reference:

Under Article 25.7 of the Federal Law "On Protection of Competition" to prevent violations of the antimonopoly law the antimonopoly body sends a written warning to an executive of an economic entity that actions which can lead to violating the antimonopoly law are unacceptable.

The grounds for sending warnings to executives of economic entities are public statements by such executives on a planned conduct on the market if such a conduct can lead to violating the antimonopoly law and at the same time there are no grounds for opening and investigating a case on violating the antimonopoly law.
