Courts confirmed that “Omskoblavtotrans” abused its market dominance

On 8 September 2016, the Arbitration Court of the West Siberian District confirmed legitimacy of a decision of Omsk OFAS regarding “Omskoblavtotrans” OJSC, and upheld the ruling of Omsk regional Arbitration Court and the 8th Arbitration Appeal Court.

In November 2015, Omsk OFAS found that “Omskoblavtotrans” OJSC abused its market dominance and violated Clause 6 Part 1 Article 10 of the Federal Law “On Protection of Competition”.

“Omskoblavtotrans” OJSC abused its dominance by economically, technologically or otherwise unreasonably fixing different prices for the same service – selling tickets for travelling and luggage carrying. The violation is committed on the market of services for carriers and passengers on organizing passenger and luggage transportation (services at bus terminals and bus stations) within the geographic boundaries of the Omsk region.

“Omskoblavtotrans” OJSC disagreed with the decision of the antimonopoly body and filed a lawsuit.

Courts of three instances, however, supported the position taken by the antimonopoly authority and dismissed the claim.
