Moscow OFAS opened a case on collusion at an auction organized by the Audit Chamber
FAS Moscow Office was informed about elements of collusion by representatives of the Audit Chamber of the Russian Federation and an auction bidder.
At an auction for refinement and support of the “Single Design Environment” automated information system of 22 August 2016, with the Audit Chamber as the ordering party, “Bonavto Global” Ltd. and “Sibstroi” Ltd. were actively filing price bids, as a result of which the original maximum contract prices went down by 93.98%.
Initially seven bids were allowed to participate in the auction. With such a significant price reduction other bidders lost an economic interest to the auctions and did not file their price bids.
In the additional bidding period, “Milovidov” Ltd. made a price offer which differed from the original maximum contract price by less than 1%.
In the second part of the biding, “Bonavto Global” Ltd. and “Sibstroi” Ltd. intentionally failed to enclose the required documents, which made a contract with them impossible. The contract had to be automatically concluded with the third cartel member - “Milovidov” Ltd. for 3,649,999.99 RUB that filed a price offer with an insignificant reduction from the original price.
Moscow OFAS studied the submitted materials and data as well as the information obtained from the electronic trading site and opened a case against “Bonavto Global” Ltd., “Sibstroi” Ltd. and “Milovidov” Ltd. upon elements of a cartel in the course of e-trading (Clause 2 Part 1 Article 11 of the Federal Law “On Protection of Competition”).
