Preferences of “Rosaviatsia” deserted a FAS warning
The Federal Air Transport Agency (Rosaviatsia) restricted competition by adopting an act with a recommendation not to use aviation kerosene made by “Ecotechnochim”
The Federal Antimonopoly Service (FAS Russia) issued a warning to Rosaviatsia for creating discriminatory conditions.
On 1 July 2016, Rosaviatsia formalized recommendations in the Protocol of a meeting with (Robinson) R-22, R-44 and R-66 helicopter operators “to do not use B-91/115 aviation petrol made by “Ecotechnochim” Ltd., Gromovo village, the Leningrad region” (breaching the GOST 1012-2013, GOST R 55971-2014 state standards).
Investigating the case materials submitted by “Ecotechnochim” Ltd., FAS found that petrol of the above grade meets all quality standards.
Such actions by Rosaviatsia can lead to violating Clauses 3, 5 and 8 Part 1 Article 15 of the Federal Law “On Protection of Competition” that prohibit federal executive bodies to pass acts and (or) exercise actions (omissions), which lead or can lead to preventing, restricting, eliminating competition, except cases of passing acts and (or) exercising such actions (omissions) provided for by the federal laws, including: prohibitions or restrictions on free movement of goods in the Russian federation, other restrictions of the rights of economic entities for selling, buying, otherwise acquiring, exchanging goods; restricting a choice of economic entities, rendering such goods, for the buyers; creating discriminatory conditions.
Guided by Article 39.1 of the Federal Law “On Protection of Competition”, FAS warns Rosaviatsia to stop the above actions (omissions) by excluding the above recommendation from Clause 7 of the Protocol and publish information about the performed actions on the official web-site of the Federal Air Transport Agency.
