The decision and determination of Perm OFAS on “Chusovoi” collusion are legitimate

The Court of First Instance dismissed claims on abolishing OFAS acts

The antimonopoly body ascertained a fact of collusion on the actions of “Mosstroi-12” Ltd. and “Urengoidorstroi” at an auction for constructing Chusovoi by-pass. The companies breached Part 1 Article 11 of the Federal Law “On Protection of Competition”. The case was opened upon a complaint from “Uralmostostroi” CJSC.

Perm OFAS found that the first parts of the auction bids were practically identical and contained the same calculation errors. Large sum transfers between accounts of these companies were a sign of collusion. These and some other evidence led OFAS to a conclusion on an anticompetitive agreement among the auction bidders.

Each company is fined 11.7 million RUB.

The companies filed a lawsuit challenging the decision and determination issued by Perm OFAS. The Court of First Instance confirmed legitimacy of the acts passed by the antimonopoly body.
