Issues of antimonopoly regulation were discussed at Moscow State University
On 7 February 2017, the Law Faculty of Moscow State University organized a Round Table on the “Pressing issues of antimonopoly regulation of business activity” and held a session of the Commission on improving the antimonopoly law
Attendees included representatives of the leading Russian legal universities, the authorities as well as the professional legal community. The Round Table became a platform to discuss the most important issues of developing competition law, drafting proposals to make changes to the current legislative acts, improving the mechanisms of the consequences for violating the antimonopoly law.
A special place in the discussion was given to liability for anticompetitive agreements, as well as improving the antimonopoly law.
Olga Franskevich, Deputy Head of FAS Anti-Cartel Department, discussed structural changes in modern cartels, which determine the need of legislative definition and more detailed regulations of liability for such violations.
Head of FAS Anti-Cartel Department Andrey Tenishev highlighted a number of controversial issues in enforcement practice on the cases on anticompetitive agreements, and made proposals on making relevant amendments to legislative acts.
“Today we need to create a fully-fledged institution of antimonopoly process with a detailed regulation of the investigation procedure for different categories of cases, as well as the procedure for participating particular categories of subjects in it. The norms of antimonopoly and criminal laws should be unified. Cartelization of public procurement also means that changes should be made to the federal contractual system”, pointed out Andrey Tenishev.
