Businessmen may complain to FAS about allocation of investment quotas for fishing

Rosrybolovstvo started selecting investment quotas in June. It will continue for six months

In 2016 amendments were made to the Law on Fishing and some other legislative acts*. In particular, a new type of quotas was introduced: quotas for harvesting (catching) aquatic biological resources for investment purposes.

The investment quotas are granted to legal entities or individual entrepreneurs for the period of investment project duration – constructing and commissioning fishing ships or Fish Products Production Plants. The quotas are allocated by the Federal Fishery Agency upon the results of selecting investment projects based on statements from businessmen.

If upon considering the complaints FAS finds that the total specified investment quotas exceed 100% allocated by Rosrybolovstvo, selection of investment projects will continue in the form of auctions.

Information about launching selection of investment projects and its procedure is published on the official web-site of Rosrybolovstvo as well as on torgi.gov.ru.

Deputy Head of FAS Rachik Petrosyan said: “In 2017 Rosrybolovstvo accepts statements for investment quotas from June for six months. FAS would like to draw attention of businessmen that they can complain to FAS regarding violations in allocating investment quotas. The antimonopoly body will consider complaints about selection of investment projects at auctions following a fast-track procedure under Article 18.1 of the Federal Law “On Protection of Competition”, without auctions – under Article 15 of the Federal Law “On Protection of Competition”.

Upon a request of the antimonopoly body, a condition is added to the current law that the contract on allocating investment quotas cannot be considered within ten days after summing up the results of investment project selection. This measure will enable business to approach FAS to protect their rights in case of their infringement.
