FAS PUBLISHED A REVIEW OF ITS PRACTICES ON THE CASES AGAINST ANTICOMPETITIVE AGREEMENTS IN 2017 AND H1 2018
The review is compiled by a Working Group of the Antimonopoly Expert Association and FAS
The Review analyses the most high-profile and interesting cases of FAS Central Office. From FAS, the co-authors of the material are Head of FAS Anti-Cartel Department, Andrey Tenishev, and Head of the Unit Special Investigations of the Department, Alexander Kornienko.
“The review, in my opinion, clearly demonstrates the already established trends in anti-cartel practice. Cases have become big and meaningful. It includes cartels on the markets within the geographic boundaries of the Russian Federation, collusions at hundreds and thousands of auctions for public procurement. Evidence, described in decisions is convincing; the qualification of the actions committed is correct. Establishing sustainable enforcement practice on cartel cases is substantiated by official statistics. Since 2011 the number of judicially appealed decisions has reduced nearly twofold. The share of reversed decisions on cartels and anticompetitive agreements dropped down by nearly four times and was 5.7% in 2017”, commented Andrey Tenishev.
“The review covers the key, most interesting cases of FAS Anti-Cartel Department. I personally took part in practically all investigations and inspections concerning the analyzed cases. We are pleased that not only the absolute majority of antimonopoly cases reached legitimate and reasoned decisions but also that after FAS appeared with inspections on particular markets — the situation with prices has been changing dramatically to the best. Reviews will be published on a regular basis. The new issue (H2 2018) is expected at the beginning of the next year.
