“OBLCOMMUNENERGO” PAID A FINE TO THE FEDERAL BUDGET
Company breached the timeline for reregistering the documents on transferring the rights of ownership over a power receiver, that could have had a negative impact upon operations of a consumer – “Nikola Tesla”
On 15 March 2017, “Nikola Tesla” Territorial Grid Company” JSC applied to “Oblcommunenergo” JSC to reregister the acts of delineating balance inventory (BI) and operational responsibility (OR) with regard to TP 26000 electric plants. The facility was transferred for ownership and use based on a property lease contract.
In breach of the deadline set by Clause 67 of No.861 Rules*, the acts were duly reregistered only on 30 March 2017 and issued to a representative of “Nikola Tesla” Territorial Grid Company” JSC.
Sverdlovsk OFAS established that actions of “Oblcommunenergo” JSC contained an event of an administrative violation under Part 1 Article 9.21 of the Code of the Russian Federation on Administrative Violations OFAS and fined the company 100,000 RUB.
The Arbitration Court of the Sverdlovsk Region and the 17th Arbitration Appeal Court upheld the fine.
“Oblcommunenergo” JSC has paid the fine.

* Under Clause 67 of No.861 Rules, in case of changing ownership (legal holder) of earlier connected power receivers, a grid company issues technical conditions registered for new owners (legal holders) no later than 7 days after the date of receiving an application for reregistering documents due to transferring the ownership right or other statutory rights for power receivers.
