ROSZDRAVNADZOR ELIMINATED SIGNS OF COMPETITION RESTRICTION IN THE MARKET OF PHARMACEUTICAL REFRIGERATOR EQUIPMENT
The Federal Service for Healthcare Supervision executed FAS warning to stop actions (omissions) that contained signs of violating the antimonopoly law
As informed earlier, re-registering pharmaceutical refrigerators, Roszdravnadzor changed their codes of the National Products Classifier by types of economic operations (OKPD2). As a result, the price of the equipment, selling which previously had not been subject to value added tax (VAT), increased by 18 % (from 1 January 2019 - by 20 %).
The antimonopoly body issued a warning to Roszdravnadzor to adjust the codes of medical products in line with the law of the Russian Federation by 15 March 2019.
Deputy Head of FAS Department for Control over Social Sphere and Trade, Maxim Degtyaryov, emphasized: “Rozdravnadzor notified FAS that the manufacturer of pharmaceutical refrigerators had been issued new registration certificates with correct OKPD2 codes. Thus, signs of competition restriction on the market of pharmaceutical refrigerator equipment have been eliminated timely and FAS is not going to open a case against Rozdravnadzor for violating Part 1 Article 15 of the Federal Law “On Protection of Competition”.
1 Under Article 39.1 of the Federal Law “On Protection of Competition”, if a warning is executed, an antimonopoly case is not opened and the person that executed the warning is not held liable for violating the antimonopoly law due to its elimination.
