“NOVOPHARM” OJSC PAID OVER 5 MILLION RUB FINE

The company is punished for an anticompetitive agreement with “PHARM-SKD” Ltd.

The 5,393,947.11 RUB fine is fully paid within the statutory period.

The anticompetitive agreement was implemented throughout more than 400 auctions for supplying medicines, medical products, disinfectants and therapeutic nourishment in five regions of Russia. The sum of the initial maximum contract prices exceeded 400 million RUB.

The over 85 million RUB fine imposed upon the second cartel participant also was paid in time.

The antimonopoly case was opened upon a statement filed by activists of the “For Fair Procurement” project of the All-Russian People’s Front.

The participants of the anticompetitive agreement challenged the FAS decisions about the fact of the violation and the fines. The Appeal and Cassation Courts, however, took the side of the competition authority.
