Earlier the same Court took FAS side recognizing the fact of violating the Federal Law “On Protection of Competition” by both companies

On 10 April 2019, Moscow Arbitration Court pronounced legitimacy of FAS order to impose administrative fines for unfair competition upon “Bavaria Brewing House” Group” Ltd. and “FAT Agrofirm” Ltd.  The companies – violators were fined 250,000 RUB each and a top-official – 12,000 RUB.

“Bavaria Brewing House” Group” Ltd. and “FAT Agrofirm” Ltd. violated the antimonopoly law by organizing promotions to sell beer produced by them and suing symbols confusingly similar to FIFA trademarks. The companies also raffled tickets for the final of FIFA 2018 World Cup, although they did not have contracts with FIFA entitling them to do it.
