COAL TRANSPORTATION IN RUSSIAN FAR EAST CAN BE A SUBJECT OF ANTICOMPETITIVE AGREEMENT
Elements of violations were exposed during joint inspections by FAS Anti-Cartel Department and Khabarovsk OFAS
The inspections revealed elements of concluding and implementing anticompetitive agreements in the actions of “Far East Generating Company” JSC, “RusHydro Snabzhenie” JSC, “VOSTEK” JSC and “TransCoal” Ltd.
The purpose of the agreements was to maintain prices at tenders for the rights to conclude contract for coal carriage by rail as to create preferential tendering conditions for part5icilar companies.
Head of FASAnti-Cartel Department, Andrey Tenishev stated: “Maintaining coal carriage prices will directly affect the population because the costs are included in the heat energy tariffs”.
A case is opened against Far East Generating Company” JSC, “RusHydro Snabzhenie” JSC, “VOSTEK” JSC and “TransCoal” Ltd. is opened upon signs of a bid-rigging cartel (Clause 2 Part 1 Article 11 of the Federal Law “On Protection of Competition”) and an anticompetitive agreement between the ordering part and bidders (Clause 1 Part 1 Article 17 of the Federal Law “On Protection of Competition”).
