CASSATION SUPPORTED FAS IN CASE OF ROAD CARTEL FOR 1.9 BILLION RUBLES

It should be reminded that in September 2022, FAS recognized the State Unitary Enterprise RostovAvtoDor and Stroitel LLC as violated antimonopoly legislation*. The companies agreed not to reduce the price in 53 procurement procedures for construction, repair and maintenance of roads in Rostov region and Republic of Kalmykia in 2017-2020. Procurement were realized within the framework of the national project “Safe high-quality roads”. The total price of government contracts was 1.9 billion rubles.

For the conclusion and implementation of a cartel agreement, fines in the amount more than 228 million rubles were imposed on organizations.

The companies tried to challenge the decisions and fines imposed by the authority, but the courts of three instances supported the FAS position.
