FAS RUSSIA AND SAMR SIGNED A MEMORANDUM OF UNDERSTANDING FOR 2024-2025

Maxim Shaskolsky, Head of FAS Russia, and Luo Wen, Minister of the State Administration for Market Regulation of the People's Republic of China, signed the document in the framework of the 28th Regular Meeting of the Heads of Government of Russia and China in Beijing

The document was developed in order to implement the Intergovernmental Agreement between the Russian Federation and the People's Republic of China on Cooperation in the Field of Antimonopoly Enforcement and Competition Policy (Beijing, 04.02.2022).

Memorandum defines specific areas of cooperation between the antimonopoly authorities of Russia and China for 2024-2025. Thus, the parties agreed on the exchange of information on the state of competition in key markets, interaction in identifying monopolistic activities and in reviewing transactions of economic concentration. The document also provides for information exchange in the field of regulation of advertising activities. In addition, for the first time, attention is being paid to the regulation of fair competition in digital markets and interaction in law enforcement against economic entities of third countries.

As part of the implementation of the document, the competition authorities agreed to exchange experiences and opinions, send notifications, requests for information and documents, and conduct consultations in the investigation of anti-competitive actions. Within the framework of the Memorandum, the parties also agreed to develop cross-border cooperation between regional offices of competition authorities.

The implementation of the Memorandum will contribute to development of cooperation between two countries in the field of competition policy and trade and economic progress of Russia and China.

Russian-Chinese cooperation in the field of combating unfair competition has been developing dynamically for more than 25 years. The main documents regulating this cooperation are the Agreement between the Government of the Russian Federation and the Government of the People's Republic of China on Cooperation in the Field of Countering Unfair Competition and Antimonopoly Policy (Beijing, 25.04.1996) and the Agreement between the Government of the Russian Federation and the Government of the People's Republic of China on Cooperation in the Field of Antimonopoly Enforcement and Competition Policy (Beijing, 04.02.2022). Besides, the FAS Russia cooperates with the antimonopoly authority of China within the framework of the BRICS on the basis of a Memorandum of Understanding on cooperation in the field of competition law and policy between the competition authorities of Brazil, Russia, India, China and South Africa (St. Petersburg, 19.05.2016).
