FAS CHANGED FORMATION RULES OF "‎WHITE AND BLACK BOOK"‎

The Authority has established a new procedure for collecting and evaluating regional practices

The document establishes uniform and specific criteria for evaluating pro-competitive and anti-competitive practices. The rules also update the areas of selection of examples and increase the effectiveness of competition advocacy in the regions.

Thus, now it is prohibited to include in the "white book" acts and measures implemented in compliance with federal laws and instructions from the Government or the President of the Russian Federation*. The FAS Russia also set the requirements according to which a regional authority has to provide an example of the positive impact of practice on a specific product market or sphere.

Besides, the Authority has expanded the list of evaluated areas. Practices on import substitution, development and implementation of digitalization tools, including digital platforms aimed at developing competition were added to the list.

With regard to the "black book”, the Authority improved the procedure for selecting examples. The Service will focus on important and precedential cases, as well as cases whose circumstances the FAS Russia has not previously considered.

In addition, the deadlines for submitting examples for inclusion in the "white and black book" have been adjusted – annually until February 1.

These changes will allow the FAS Russia to form the "white and black books" more quickly. As a result, the regions will be able to apply the best practices for the development of competition faster.
