FAS revealed elements of violating the antimonopoly law by Rosrezerv
The Federal Antimonopoly Service (FAS Russia) opened a case against the Federal State Reserves Agency (Rosrezerv) upon elements of violating the Federal Law “On Protection of Competition” (Part 2 Article 17).
The case was initiated upon a complaint filed by “Tatneftsnab” Office, “Tatneft” OJSC. According to the complaint, the Agency unlawfully refused to accept applications for taking part in closed tenders for sale of material values from the state reserve.
Such actions by Rosrezerv have signs of violating the antimonopoly law in the part of restricting access to competitive bidding by the authorities not provided for by the federal laws or other regulatory acts.

If organizers of competitive bidding, quotation requests, requests for proposals or customers are federal executive bodies, executive bodies of the subjects of the Russian Federation, local self-government bodies, state extra-budgetary funds, as well as in the course of competitive bidding, quotation requests, requests for proposals for procurement of goods, works, services for state and municipal needs, restricting access to participation in competitive bidding, quotation requests, requests for proposals contrary unless provided for by federal laws or other regulator acts is prohibited.
