“Lenenergo” lost 50 millions

The 13th Arbitration Appeal Court pronounced legitimacy and reasonableness of a 49,568,640 RUB fine upon “Lenenergo” PJSC.

The grid company failed to undertake timely reasonable measures for technological connection of power-receiving devices of more than ten physical persons and legal entities, which infringed consumer interests (in breach of Part 1 Article 10 of the Federal Law “On Protection of Competition”). St Petersburg OFAS fined “Lenenergo” PJSC nearly 50 million RUB  for committing the violation  (Part 2 Article 14.31 of the Code of the Russian Federation on Antimonopoly Violations), that the company attempted to appeal at the Courts of First and Second Instances to no avail.

The Court of First Instance reduced the second big fine imposed upon the monopolist by the antimonopoly body – over 57 million RUB – to 28,553,220 RUB.

The total sum of the fines imposed by the antimonopoly body upon “Lenenergo” PJSC, in view of the above, reaches nearly 100 million RUB, of which the company paid 3,200,000 RUB. The remaining sum is being challenged by the monopolist in Courts of various instances.
