Sergey Puzyrevskiy: the issues of education and science take the leading position in the National Competition Development Plan

The Plan provides for devising professional standards in the competition law

Deputy Head of FAS Sergey Puzyrevskiy started a regular session of the Commission on Competition Law and Antimonopoly Regulation of the Russian Lawyers Association with congratulations to the team of the “Competition Law” journal that marked its 5th anniversary.

He pointed out that the journal had done a lot to popularize the standards of the antimonopoly law and competition advocacy.

“FAS devised the National Competition Development Plan, where the issues of education and science are on the leading place. We believe that professional standards in the competition law should be developed. It will be a powerful impulse for training specialists at educational institutions”, said Sergey Puzyrevskiy.

Then participants discussed FAS draft law on introducing antimonopoly control over establishing unitary enterprises.

Head of FAS Legal Department Artem Molchanov reported that the draft Plan is put on regulation.gov.ru and is available for public consultations, and gave data of increasing state participation in the economy.

He also raised a question to the representatives of the legal community on еру efficiency of such enterprises in the current economic conditions.

“As follows from the conclusions of the Expert Council at the Government of the Russian Federation, there is no clear mechanism of corporate control over unitary enterprises. Productivity of the workers of such organizations on average is 4.5 times lower that workers of the companies with other organizational and legal forms”, continued Head of FAS Legal Department. “State and municipal unitary enterprises obtain unreasonable advantages in comparison with companies that enter the market independently”.

According to Artem Molchanov, the problem can be solved through a draft Law devised by FAS and designed to: first, stop state and municipal unitary enterprises spreading out; and second, reduce the share of state participation in the economy.

The legal and academic communities approved the Plan in general and expressed their readiness to support it albeit some further refining.

Finally, the participants looked into proposals in improving the Federal Law “On Protection of Competition” in the part of control over economic concentration.

Next time the Commission will meet in spring 2017.
