Russian Courts will continue considering the dispute between FAS and Google

The corporation claimed that Moscow Arbitration Court was not competent to examine the case

On 22 February 2017, the 9th Arbitration Appeal Court dismissed the claim of Google that asked to transfer the case for consideration to a different Arbitration Court

Thus, the Appeal Court confirmed the definition given by the Court of First Instance that had been appealed by the corporation on 14 February 2017.

FAS filed a claim to Moscow Arbitration to force Google to execute a determination issued by the antimonopoly authority.

“In the opinion of the antimonopoly body, the dispute falls in an exclusive competence of the Arbitration Courts of the Russian Federation”, said Deputy Head of FAS Legal Department, Larisa Vovkivskaya.

Google petitioned to transfer the case to the Arbitration Court of the Moscow region.

The Court of First Instance dismissed the claim of the corporation and the Appeal Court confirmed the rightness of the conclusions reached by Moscow Arbitration Court.

Thus, Moscow Arbitration Court shall continue hearing the case.
