FAS studied international experience of merger / acquisition investigations
In February 2017 a representative of FAS Department for Control over Foreign Investments took part in a hand-on workshop in Washington (USA) on methods of M&A investigations, organized by the International Competition Network (ICN) with support from the Federal Trade Commission and the US Department of Justice.
The workshop included lectures and Round Tables, the purpose of which was to present analytical data of ICN Mergers and Acquisitions Working Group, recommendations on devising an investigation plan, establishing and reliable evidence base, defining the market in M&A analysis. Alexander Poroshin, Deputy Head of the Legal Unit, FAS Department for Control over Foreign Investments, moderated two Round Table sessions.
The event participants – around 120 representatives of foreign competition authorities, law firms and specialists in the field of antimonopoly practice exchanged experiences and reviewed a case on merging the largest producers of energy drinks on the market, prepared by the organizers. The business game when the case was reviewed revealed specifics of investigating M&A in the USA.
According to Head of FAS Department for Control over Foreign Investments, Andrey Yunak, participation of FAS representatives in such events allows establishing new working contacts with foreign colleagues, obtain new knowledge and present FAS position on the issues in questions. “Further rapprochement of competition authorities and setting up strong professional bonds is of absolute importance under the ongoing globalization processes”, emphasized Andrey Yunak.
