FAS fined “Gazpromneft Moscow Oil Refinery” JSC

The company must submit information to the antimonopoly authority on transmitting electric power to particular categories of consumers  

In view of mitigating circumstances’ FAS fined “Gazpromneft Moscow Oil Refinery” JSC 50,000 RUB.

The company failed to submit information provided for by the federal statistical observation form. The obligation is formalized by a Rosstat [Russian Federal State Statistical Service] Order*.

Dmitry Vasiliev, Head of FAS Department for Regulating Electric Power Industry pointed out: “Actual information about electric power transmission to particular consumer categories is one of the basic elements of ensuring demand and reliable power supply. Making balanced tariff decisions depend on timey submission of such information”.

*No. 257 Rosstat Order of 03.07.2013 establishes that No. 46-EE Form (transmission) must be filled in monthly (by the 20th day after the reporting month) and annually (by 10th February of the reporting year) in the FAS system to form a consolidated balance forecast on generating and supplying electric power (capacity) within the Unified Energy System of Russia.

Part 1 Article 19.7.1 of the Code of the Russian Federation on Administrative Violations establishes liability for failure or late submission of information to the body exercising government control (supervision) in the field of government-regulated prices (tariffs) if regulatory acts obligate to submit such information to ascertain, change, introduce or abolish tariffs, in the form of administrative fines:

- uponofficialsfrom 3000 RUBto 5000 RUB

- uponlegalentitiesfrom 50,000 RUB to 100,000 RUB.
